COMPLIANCE CORNER "THE TIMES THEY ARE A-CHANGIN" VERSE II "The Times They are A-Changin" for the NCAA. As I wrote in the last Com- pliance Corner, the NCAA is undergoing major changes in five areas: student- athlete well being; academic performance; NCAA bylaws; the enforcement and penalty process; and fiscal sustainability in Division I. Previously, we discussed student-athlete well-being and academic performance. In this edition, we will discuss NCAA Bylaws, enforcement and fiscal sustainability. The NCAA Bylaw Working Group was created to review and amend the Division I Manual to reduce unenforceable and inconsequential rules that fail to support NCAA enduring values, and focus on those that are meaningful, enforceable and supportive of student-athlete success. Therefore, every rule will be attached to a tenet of Division I or a principle of the overall Association. Currently, the group is examining the elimination or changes in bylaws: 11-Athletics Personnel; 12-Amateurism; 13-Recruit- ing; 14-Eligibility; 15-Financial Aid; 16-Awards, Benefits and Expense; and 17-Playing and Practice Seasons. Since March, the group has sought feedback from all Division I institutions on proposed rule changes and/or eliminations to current rules in each of the bylaws mentioned above. For example, in Bylaw 13-Recruiting, the current rule places limits on the modes of communication (phone and e-mail only), numerical limitations on how often a coach may call prospects (once per week) and when they may begin calling a prospect (July 1 after junior year). The proposed rule change would allow coaches to call prospects earlier in their high school career (June 15 after completion of the sophomore year), use any mode of communication (text, phone, Facebook) and after the new start date, coaching staffs could call an unlimited number of times. The Enforcement Working Group was created to make the enforcement process more efficient (process cases faster) and more effective (institute strong penalties that are more predictable). Similar to the Bylaw Working Group, this group has been seeking feedback from the Division I membership on the following ideas: a four-level violation structure (instead of the current two); more Committee on Infractions (COI) members serving on panels rather than the entire COI hearing every case; and a penalty structure with guidelines for imposing core penalties. The last working group, Fiscal Sustainability or Resource Allocation Working Group, was in charge of reviewing current practices and rules at the institutional and NCAA levels to recommend efficiencies that recognize the new economic realities. The focus of the group was how to contain costs across the Division I membership. During initial meetings of this group, many cost savings measures were consid- ered.
