Recently, the phenomenon of crowdfunding has become another area for compliance offices to monitor. Crowdfunding is the practice of funding a project or venture by raising monetary contributions from a large number of people, typically via the Internet. In NCAA Division I, under current NCAA legislation, a student-athlete's name or picture cannot be used to promote or to solicit funds for a commercial product or service of any kind. This prohibi- tion applies to traditional, brick-and-mortar businesses, commercial websites, for-profit crowdfunding sites and other online businesses that seek to use a student-athlete's name, picture or likeness for any commercial purpose (e.g., promotion, generation of revenue). A student-athlete may not use his or her name, picture or athletics reputa- tion to solicit funds through a personal online profile or crowdfunding site. Therefore, a student- athlete's eligibility to compete in intercollegiate athletics in a particular sport is jeopardized if he or she uses his or her name, picture, athletics skill or reputation to earn pay in any form in the sport, including funds through a crowdfunding website for items of need. As VAF members, if you see a crowdfunding site that contains the name, picture or likeness of a UVA student-athlete, it would not be permissible to contribute funds to the site on behalf of the student-athlete. Further, if you find a crowdfunding site that is using the name, picture or likeness of a UVA student-athlete, please contact the UVA Compliance Office so we can send a cease and desist letter in order to protect the student-athlete's eligibility. Eric Baumgartner Associate Athletics Director for Compliance COMPLIANCE CORNER CROWDFUNDING CAVS FOR LIFE SPOTLIGHT JONATHAN FAUSEY Jon Fausey, a University of Virginia alumnus from Dalmatia, Pa., forever changed the wrestling program from the moment he arrived on Grounds in 2009. While competing for the University of Virginia, Jon qualified for four NCAA championships and in 2012 earned an ACC championship at 184 pounds. These accolades and accomplishments are impressive, but what is even more impressive is Jon's growth and selflessness over the course of his five years at UVA. Coach Garland attests that this was the lasting impression Jon left on the wrestling program. Jon's fifth year was plagued with injuries as he tore two labrums, but that didn't stop him from serving the team in any way he could. As Coach Garland notes, "Jon understood it was bigger than himself, it was about honoring God with the gifts of talent and the hand he was dealt. The situa- tion wasn't fun, but there were some amazing things that came out of it. It was Jon's worst season
