Compliance Corner Beginning of the Year Reminder "ASK BEFORE YOU ACT" The University of Virginia (UVa) Athletics Department is very appreciative of your support. As a supporter of Virginia Athletics, the NCAA considers you a representative of our athletics interests (booster). Please review the imbedded link for NCAA rules regarding representatives of athletics interests: http://www.athletic.virginia.edu/compliance/ information-for-uva-boosters-alumni-and-faculty/ As a representative of UVa's athletics interests, the NCAA has strict rules governing your interactions with both prospective and current student-athletes and their families. Specifically, you may not provide an "extra benefit" to prospective or current student-athletes or their family members. Extra Benefit: The term "extra benefit" refers to any special arrangement by an institutional employee or representative of the institution's athletics interests (booster) to provide the student-athlete or his or her relatives or friends with a benefit not expressly authorized by NCAA legislation. For example, on the NCAA database of violations, an extra benefit violation was reported when the parent of a student-athlete received a ticket from a representative of an athletics interest. The violation was unintentional and involved the parent receiving a ticket to attend a home contest from the booster. The parent did not have a prior relationship with the booster; however, accepted the benefit which caused an NCAA extra benefit violation. Benefits from Boosters: Is it permissible for a booster to provide a benefit to a prospective, current or former student-athlete or their families? The NCAA has determined that an institution must analyze the relationship between the booster and prospective, current or former student-athlete using the four part test below to determine if there is an established relationship between the booster and student-athlete. The questions below will help you and UVa determine whether you have an established relationship with a student-athlete. If an established relationship is determined, UVa must analyze the types of benefits that were provided to the student-athlete prior to the student-athlete becoming a prospect, current or former student-athlete. Did the relationship between the athlete (or the athlete's parents) and the individual providing the benefit(s) develop as a result of the athlete's participation in athletics or notoriety related thereto? Did the relationship between the athlete (or the athlete's parents) and the individual providing the benefit(s) predate the athlete's status as a prospective student-athlete? Did the relationship between the athlete (or the athlete's parents) and the individual providing the benefit(s) predate the athlete's status achieved as a result of his or her athletics ability or reputation? Was the pattern of benefits provided by the individual to the athlete (or the athlete's parents) prior to the athlete attaining notoriety as a skilled athlete similar in nature to those provided after attaining such stature?
