Eventually, Judge Hostetler ruled that Indiana's current Access to Public Records Act (APRA) does not apply to private colleges and universities that appoint police officers, including the NDSP. Hostetler's ruling was the Court recognizes Notre Dame and other private universities that appoint campus police officers as "state actors," not public agencies. "The powers given to officers appointed by Indiana's private colleges and universities are significant," Hostetler wrote. "However, it does not follow that Notre Dame is a public agency under APRA simply because NDSP is a 'state actor' for constitutional law purposes." Britt had opined that NDSP was a public agency and subject to APRA. "We are pleased that Judge Hostetler has agreed with the long-recognized status of the university's records," said Paul Browne, Notre Dame's vice president for student affairs and communications. "As always, our police department will continue to investigate and report in a manner consistent with the highest standards of law enforcement and in accord with state law." It remains uncertain whether ESPN is going to appeal Hostetler's ruling. Afternoon Kickoff Vs. Virginia The ACC announced that Notre Dame's first road game of the season, at Virginia Sept. 12, will kick off at 3:30 p.m. ABC-TV will telecast the contest nationally. Notre Dame now has kickoff times set for two of its six road games, the other being the Shamrock Series versus Boston College Nov. 21 at Fenway Park (7:30 p.m.). The six at home will feature 7:30 p.m. kickoffs versus Texas (Sept. 5) and USC (Oct. 17), and 3:30 p.m. starts against Georgia Tech (Sept. 19), UMass (Sept. 26), Navy (Oct. 10) and Wake Forest (Nov. 14). All times are Eastern. Irish to face Illini In ACC-Big Ten Challenge Notre Dame will play at Illinois Dec. 2 in the annual men's basketball Big Ten/ACC Challenge. The Irish hosted and defeated Michigan State this past season, and lost at Iowa the year prior. The most recent meeting between the Irish and Illini was 2003 when the 68-60 Notre Dame win in the NCAA Tournament advanced them to the Sweet 16 for the first time in 16 years. The two schools haven't played in the regular season since January 1973, and it will be Notre Dame's first trip to Champaign since 1963. Illinois leads the series 27-13. UNDER THE DOME
